Terms of Service
By purchasing/selling designs apart of the species, you are choosing to agree and follow to these terms of service. Breaching these terms can result in a ban from purchasing and creating any design involved with this species and your designs may be retracted or another penalty will be given. It is your responsibility to read these terms before you purchase or create designs within the species and keep updated with these terms.
| Consumer/Customer
➜ When purchasing a design you are purchasing partial rights to the character design and for MYOs (Make Your Own) you are giving partial rights to the species owners.
➜ You cannot use official adoptables for commercial use, only for personal use. For MYOs, you must ask permission from the Admins and the artist of your MYO design.
➜ All adoptables, characters and lore cannot be used in NFTs or in AI databases. You do NOT have our permission.
➜ When trading or reselling a design you have to comment on the Akimaru Masterlist about the ownership change to prevent fraud.
➜ You may trade the design for others designs (non-species is allowed).
➜ You may resell the design for the equal amount you paid for or less.
➜ If the rarity of a design changes, the value of it will. The value of it will be the rarities starting bid price or MYO rarity price.
➜ You may claim a adoptable, MYO Slot or MYO on behalf of someone else.
➜ You may gift a adoptable, MYO Slot or MYO to someone else.
➜ Co-owning is allowed, max 2 owners per 1 adopt.
➜ All co-owners must pay 50/50.
➜ You must have your co-owners approval before reselling or trading your half of the ownership, the co-owner must approve the individual buying the ownership.
➜ Akimaru characters can be apart of another species with our admins permission.
➜ You may convert an off-species adoptable into our species, ensure you have permission from the original artists and ensure it does not go against their adoptable TOS.
➜ Official Akimaru adoptables can be apart of other species with our admins permission, but they cannot be voided from the Akimaru species.
| MYOs
➜ You may resell a MYO for equal the amount you paid for or less. If you have won, been gifted or traded a MYO, you can only Gift or Trade them.
➜ Do not purchase another MYO token until you have used the prior tokens.
➜ When creating your MYO, copying and heavily referencing pre-existing characters, series and adoptables is not allowed. Admins will ask you to redesign them to be approved.
➜ MYO tokens do NOT have an expiry date.
➜ You cannot change the MYOs species or spiritual essence once created, but you may redesign them. (Let admins know that you want to redesign your MYO, as it will have to be approved again.)
| Guest Designer
➜ All designs you create for the Akimaru Species, the species owners holds partial rights to with the customer.
➜ You are not allowed to stream adoptable designs or show wips of them unless you have permission from Admins before hand. (If previews of the adoptables are released, you are allowed to stream your process.)
➜ You have the rights to claim yourself as the creator/designer of the adoptable design you made.
➜ Guest Designers receive 100% of the profit from these adoptables, only paypal fees apply.
➜ Guest Designers are not allowed to claim their own designs in events, unless it has not been sold within 2 months of releasing.
➜ If the adopt is not sold after 2 weeks, you may request to change it from Auction to Setprice or OTA. The minimum for Setprice or OTA is the SB for the adopt. Same is for the maximum Setprice or OTA, it cannot go higher than the AB of the adopt.
➜ Guest Designers have the right to decline any sales from individuals. (The Guest Designers blacklist applies to Akimaru CS. Once admins are notified the bid will be removed.)
➜ Guest Designers are allowed to make off-event adoptables. (Let Admins know your plans before you start designing.)
➜ Missing a deadline will result in a strike, if you have three strikes, we will have to let you go as a Guest Designer.
| Payment
➜ All payments must be made within 48 hours after the purchase of the design.
➜ The currency that is accepted is USD.
➜ Payments must be made through Paypal or Kofi.
➜ Payment plans are accepted if the Guest Designer accepts.
➜ You do NOT own the adoptable until your payment plan is finished. Once the payment plan is finished, the Guest Designer will send over the files.
➜ Regarding payment plans you must pay atleast 25% upfront.
➜ Maximum payment plan duration is 3 months.
➜ You will receive the unwatermarked design and partial character rights upon payment plan completion.
➜ Failure to finish paying your payment plan, will result in a ban from the species and no refund will be given.
➜ First time owners can only have 1 payment plan at one time. If you are not a first time owner, you may have a maximum of 2 payment plans at once.
| Refunds & Cancelling
➜ Filing a chargeback will have you banned from the species and banned from purchasing anything related to species (adoptables, MYO tokens, etc).
➜ Refunds are not available. Be 100% sure you can buy a design before you bid/purchase.
Breaching these Terms
Failure to follow these terms will result in temporary ban, full ban or blacklist from the species.

Creating a design that has similar features to my species does not mean it is apart of the species, but do NOT heavily reference characters from the species.
Closed Species means I, Nyakiiboo and the people I currently give permission to are allowed to create an Akimaru design.
I do not copyright the use of wings, crystals, mermaid tails and animal features on any designs, however I do copyright the designs I make, and that are apart of the species. The specific lore and traits are what make an Akimaru design.
